Possible operational disruptions and their effects on the neighborhood, the general public and employees (e.g. releases or reactions of substances) must first be assessed. Based on this, the planned technical and organizational measures for preventive (prevention) and defensive (limitation) protection against operational disruptions are examined.
Procedure
To check whether an establishment falls within the scope of the Major Accidents Ordinance, the entire area under the supervision of an operator must first be determined. All hazardous substances within the meaning of the StörfallV present in this area must then be identified. In accordance with the requirements of Annex I of the Major Accidents Ordinance, the relevant substances identified and their quantities must be used to calculate whether the quantity thresholds of Annex I of the Major Accidents Ordinance are reached or exceeded.
Classification of waste KAS-61
The KAS-61 guideline is particularly relevant for the classification of waste. This gives you the option of classifying waste on a general basis or with the help of detailed knowledge. However, as the blanket classifications are necessarily conservative, it is often worth considering your waste fractions on a case-by-case basis (classification with detailed knowledge). We would be happy to classify your waste for assessment in accordance with the Hazardous Incident Ordinance.
Information in accordance with Article 7 of the Major Accidents Ordinance
Article 7 of the Major Accidents Ordinance (12th BImSchV) specifies the information required for notification in accordance with the Major Accidents Ordinance. This includes information on the identification of the operating area, information on the substances and activities handled and information on the immediate surroundings of the operating area.
Safety report in accordance with § 9 of the Major Accidents Ordinance (12th BImSchV)
Operators of upper-tier operating areas are obliged to prepare a safety report in accordance with § 9 of the Major Accidents Ordinance before commissioning. A safety report must be submitted as part of the immission control licensing procedure in accordance with Section 4b (2) of the 9th BImSchV in conjunction with Section 9 of the Major Accidents Ordinance. This applies to those parts of the safety report that correspond to Sections II Nos. 1, 3 and 4 and Sections III to V of Annex II of the Major Accidents Ordinance.
Construction or modification relevant to major accidents pursuant to Article 3 (5b) BImSchG
Construction or modification relevant to major accidents pursuant to Article 3 (5b) BImSchG is deemed to exist if it could have a significant impact on the risks of major accidents. A major-accident-relevant change also exists if a change could lead to a lower-class operating area becoming an upper-class operating area or vice versa (see Section 2 Nos. 1 and 2 of the Major Accidents Ordinance).
Appropriate safety distance (KAS-18, § 50 BImSchG)
If there is an accident-relevant construction or modification, information on the appropriate safety distance in accordance with § 3 (5c) BImSchG is required. First of all, the appropriate safety distance (distance between an operating area and a neighboring protected object) must be determined. Based on this, it is essentially necessary to assess whether and how protected objects within the meaning of § 3 (5d) BImSchG are affected.
Safety inspections in accordance with Section 29a BImSchG
In accordance with Section 29a BImSchG, the authority can order safety inspections for installations or plants requiring a permit within an operating area in accordance with Section 3 (5a) BImSchG. This may also be required for safety-related documents as part of immission control approval procedures.
Procedure
As the level of detail of the system planning does not always allow a final explosion protection assessment at the time of the application, we prepare a preliminary explosion protection document for you that meets all the requirements of Section 6 (9) GefStoffV and is suitable for submission to the competent authority. In the further course of planning, we remain your partner for the explosion protection assessment of the system and prepare the final explosion protection documentation for you or support you with further requirements such as tests in accordance with BetrSichV or training of your employees (see also Explosion protection department).
Necessity
The explosion protection document must be created before commissioning, as it forms the basis for the pre-commissioning inspection in accordance with Section 15 BetrSichV and the training of your employees.
Contents
Information is required on compliance with the requirements of plant-related water protection. In principle, all planned facilities must be included and assessed with regard to their suitability under water protection law.
