Hazardous incident law
Due to the materials handled and in particular the residual materials produced, thermal waste recycling plants can become operating areas in accordance with § 3 (5a) BImSchG, i.e. “major accident” plants.
We have specialized in particular in the assessment of residual materials and input materials in accordance with accident law. We are happy to offer you the following services:
Suitability assessment
Expert opinion in accordance with Section 41 AwSV
According to § 63 WHG, the suitability of facilities for storage, filling and handling (LAU facilities) must be determined before construction and operation as well as after significant changes.
We will be happy to provide you with the relevant reports for submission to the competent authority.
Suitability assessment
Expert opinion according to § 42 AwSV
As part of the suitability assessment in accordance with Section 63 WHG, authorities may require the submission of an additional water protection expert opinion from an AwSV expert.
We will be happy to support you in communicating with the authorities to clarify the scope of the expert opinion and prepare the required expert opinion for submission to the authority responsible for you.
Inspections
according to § 47 AwSV
Systems that fall within the scope of the AwSV must be inspected by an expert within the meaning of the AwSV in accordance with Section 47 AwSV.
We are happy to offer to carry out the necessary inspections for your AwSV systems.
Consulting
Do you have a specific question about the AwSV?
Feel free to contact us, we will of course also be happy to advise you on all your questions about plant-related water protection.
Classification of residual substances
within the meaning of the Major Accidents Ordinance (12th BImSchV)
Waste (residual substances) must be assigned to the most similar hazard category or the most similar named substance in accordance with the Major Accidents Ordinance in terms of their major-accident potential.
The KAS-61 guideline provides both a general assessment option and the option of classification with detailed knowledge. However, as the blanket classifications are necessarily conservative, it is often worth classifying your waste fractions using detailed knowledge. We would be happy to classify your waste for assessment in accordance with the Hazardous Incident Ordinance.
